mso-ascii-font-family: &#39;Times New Roman&#39;; mso-hansi-font-family: &#39;Times New Roman&#39;">尽管如此,某些用人单位试图以各种形式躲避法规约束,以各种名目延长试用期,甚至很多单位每年都有试用期。《劳动合同法》为此对试用期的时间周期上作出了严格限定</SPAN><SPAN lang=EN-US>“</SPAN><SPAN style="FONT-FAMILY: 宋体; mso-ascii-font-family: &#39;Times New Roman&#39;; mso-hansi-font-family: &#39;Times New Roman&#39;">第十九条 劳动合同期限三个月以上不满一年的,试用期不得超过一个月;劳动合同期限一年以上不满三年的,试用期不得超过二个月;三年以上固定期限和无固定期限的劳动合同,试用期不得超过六个月。</SPAN> <SPAN style="FONT-FAMILY: 宋体; mso-hansi-font-family: &#39;Times New Roman&#39;">、关于违约金及经济补偿金</SPAN><SPAN lang=EN-US><BR></SPAN><SPAN style="FONT-FAMILY: 宋体; mso-ascii-font-family: &#39;Times New Roman&#39;; mso-hansi-font-family: &#39;Times New Roman&#39;">针对一些用人单位限制劳动者的择业自由和劳动力的合理流动问题,完善了有关违约金规定。《劳动合同法》规定在</SPAN><SPAN lang=EN-US>“</SPAN><SPAN style="FONT-FAMILY: 宋体; mso-ascii-font-family: &#39;Times New Roman&#39;; mso-hansi-font-family: &#39;Times New Roman&#39;">第二十二条到第二十五条</SPAN> <SPAN style="FONT-FAMILY: 宋体; mso-ascii-font-family: &#39;Times New Roman&#39;; mso-hansi-font-family: &#39;Times New Roman&#39;">培训服务期约定中可以约定违约金;规定在竞业限制约定中可以约定违约金;除以上两种情形外,用人单位不得与劳动者约定由劳动者承担违约金。</SPAN><SPAN lang=EN-US>”</SPAN><SPAN style="FONT-FAMILY: 宋体; mso-ascii-font-family: &#39;Times New Roman&#39;; mso-hansi-font-family: &#39;Times New Roman&#39;">《劳动合同法》明确劳动合同终止也要补偿,既体现了按照国际通行做法,对诚信履行劳动合同员工的一种鼓励,也体现了对员工离职后可能面临的</SPAN><SPAN lang=EN-US>“</SPAN><SPAN style="FONT-FAMILY: 宋体; mso-ascii-font-family: &#39;Times New Roman&#39;; mso-hansi-font-family: &#39;Times New Roman&#39;">生存权</SPAN><SPAN lang=EN-US>”</SPAN><SPAN style="FONT-FAMILY: 宋体; mso-ascii-font-family: &#39;Times New Roman&#39;; mso-hansi-font-family: &#39;Times New Roman&#39;">问题的保护。在解除劳动合同方面,按现行《劳动法》,过去只有在用人单位</SPAN><SPAN lang=EN-US>“</SPAN><SPAN style="FONT-FAMILY: 宋体; mso-ascii-font-family: &#39;Times New Roman&#39;; mso-hansi-font-family: &#39;Times New Roman&#39;">解除</SPAN><SPAN lang=EN-US>”</SPAN><SPAN style="FONT-FAMILY: 宋体; mso-ascii-font-family: &#39;Times New Roman&#39;; mso-hansi-font-family: &#39;Times New Roman&#39;">未到期的劳动合同时,无过错的劳动者才会获得补偿;如果是合同到期终止,一般情况下劳动者不会得到任何补偿。由此可见,《劳动法》中经济补偿金属于劳动合同履行中违约金的性质,即只有在用人单位单方面解除或主动提出解除劳动合同的时候,才必须支付经济补偿金。</SPAN><SPAN lang=EN-US><BR>9</SPAN><SPAN style="FONT-FAMILY: 宋体; mso-ascii-font-family: &#39;Times New Roman&#39;; mso-hansi-font-family: &#39;Times New Roman&#39;">、关于劳动合同的履行和变更</SPAN><SPAN lang=EN-US><BR></SPAN><SPAN style="FONT-FAMILY: 宋体; mso-ascii-font-family: &#39;Times New Roman&#39;; mso-hansi-font-family: &#39;Times New Roman&#39;">有些企业中劳动者会在拒绝错误指令时遭到企业开除,理由是劳动者违反了劳动合同。或者出现某些企业想开除某员工时会故意设置违章指令让员工就范,如员工拒绝执行则此作为解除合同的依据。旧的《劳动法》中第五十五条规定</SPAN><SPAN lang=EN-US>“</SPAN><SPAN style="FONT-FAMILY: 宋体; mso-ascii-font-family: &#39;Times New Roman&#39;; mso-hansi-font-family: &#39;Times New Roman&#39;">劳动者对用人单位管理人员违章指挥、强令冒险作业,有权拒绝执行;对危害生命安全和身体健康的行为,有权提出</SPAN><SPAN lang=EN-US><BR></SPAN><SPAN style="FONT-FAMILY: 宋体; mso-ascii-font-family: &#39;Times New Roman&#39;; mso-hansi-font-family: &#39;Times New Roman&#39;">批评、检举和控告。</SPAN><SPAN lang=EN-US>”</SPAN><SPAN style="FONT-FAMILY: 宋体; mso-ascii-font-family: &#39;Times New Roman&#39;;
